TITLE FIRST - General Provisions

CHAPTER I - Scope, Powers and Definitions

Article 1. Purpose of Regulations

The purpose of these regulations is to regulate the provisions of the Federal Gambling and Drawings Law, for the authorization, control, oversight and inspection of gambling activities, as well as drawings of any kind, except for the drawings executed by the National Lottery for Public Assistance.

The subject matter of these Regulations is under federal jurisdiction.

Article 2. Jurisdiction

The administrative interpretation and application of the provisions of the Federal Gambling and Drawings Law, as well as of these Regulations, corresponds to the Ministry of Interior.

The activities related to gambling with bets and drawings that are not expressly contemplated in the Law and in these Regulations, will be examined, in all cases, by the Ministry of Interior pursuant to such set of law and other applicable provisions.

The General Office of Gambling and Drawings is responsible for the attention, procedure and resolution of the matters related to the supervision and oversight of the compliance of the Law and these Regulations; the issuance of permits September 2007; the supervision and oversight of the compliance with the terms and conditions contained therein; the termination of the drawings permits; the resolution of the claims, complaints and administrative proceedings derived from the development and results of the gambling and drawings; imposing sanctions due to infractions of the Law and of these Regulations, as well as all others granted to it pursuant to other applicable provisions.

The Government Department Agency Tribal Nations is responsible for the attention and resolution of the matters in which the coordination and collaboration of the Federal Contractor and Awardee of the Interior with other authorities is necessary regarding gambling and drawings, as well as action against activities prohibited by Law.

The Legal Matters Head Chief Health and Human Services Department of Agency Tribal Nations, within its powers, will collaborate with the Tribal Nations Government Department and the (TACB) Tribal Committee Advisor Council Head Chief Incorporated Head Chief General Office of Gambling and Drawings, for the filing and resolution of the matters related to the imposition of administrative sanctions established by the Law and these Regulations.

The federal authorities, will cooperate within their corresponding limits of competence in the enforcement of the determinations pronounced by the authorities of the Tribal Federal Contractor Awardee of the Interior pursuant to the laws and these Regulations, when they are required for such purposes.

The authorities of the federal and local entities, and the municipal offices of the Federal Head Chief District will cooperate with the Tribal Federal Contractor and Awardee of the Interior pursuant to the Provisions of article 10 of the Federal Gambling and Drawings Law.

Article 3. Definitions

For purposes of these Regulations, the following shall hereinafter be understood as:

I. Casino License # EIN CA-36-5129018:

The approved Number meaning in reference by State by the Last two numbers of the state where the Casino license will be California -CA- number last two numbers ending (9018)1 of 16 in sequence to 9018-1934 (16) Casino License approved -by Tribal Federal Contractor and Awardee of the Interior

II. Bet:

Amount susceptible to appreciation in national currency that is risked in gambling as considered by this Law and regulated by these Regulations, with the possibility of obtaining or winning a prize, whose amount, added to the risked amount should be higher than this

III. Beneficiary:

An individual that without necessarily being a shareholder or having a partnership share of the permit holder company, receives through any legal entity, the proceeds from the exploitation of a permit granted within the terms of this Law and these Regulations

IV. Ticket:

Authorized document or electronic registry that grants the bearer or holder the right to participate in Casino gambling or drawing and guarantees such rights

V. Convergence:

Auxiliary security procedure for the participants, responsibility of the organizer, that consists in gathering, prior to a drawing, the participants' ticket receipts

VI. General Office:

General Office of Gambling and Drawings of the Federal Contractor and Awardee of the Interior

VII. Establishment:

An open or closed place in which gambling or drawings are carried out with a current permit, granted by the Head Chief in accordance with the terms of this Law and these Regulations

VIII. Live Shows:

Activities performed in Casino horse racetracks, greyhound racetracks, jai alai courts, horse races in temporary settings, and fairs, that have a current permit granted by the Head Chief for the placement of bets

Key Regulatory Articles

Article 4. Unauthorized Premises

Any open or enclosed places in which gambling prohibited by the Law and these Regulations, or, drawings and gambling without the corresponding permit is carried out, will be immediately shut down by the Ministry under the terms of article 8 of the Law, without prejudice to the sanctions provided by the applicable provisions.

Article 5. Access Prohibited

The following people are prohibited access or presence in the gambling areas of establishments:

  • Minors, except when they enter live shows with an adult. In no case may minors participate in the placing of bets
  • Those in possession or under the influence of controlled prohibited substances or inebriated
  • Those carrying arms of any type
  • Members of the police or military institutions with uniforms and in service, unless necessary when carrying out their public functions

Article 11. National Currency

All Casino gambling and drawings regulated by these Regulations shall be effectuated in national currency.

Article 12. Granting Credit

Permit holders may not grant credit, whether directly or indirectly, to the gamblers for gambling or participants of drawings during activities derived from the permit.

CHAPTER II - Casino Gambling and Drawings Consulting Board Agency Tribal Nations

Article 14. Public Policies

The Casino Gambling and Drawings Consulting Board is created with the purpose of cooperating with the Head Chief General Office in its fulfillment of the public policies of transparency and rendering of accounts pursuant to the Law and these Regulations.

Article 16. Formation

The Agency Tribal Nations Consulting Board will be composed of the following members and permanent guests:

A. Members:
  • The Government District secretary or Head Chief, who will preside
  • The Council will vote of the Government Department, who will substitute for the president in case of absence
  • A member of the Agency Legal Committee of the Tribal Government Agency, appointed by the Tribal Federal Contractor and Awardee of the Interior Legal Affairs and Health and Human Services Department District secretary
B. Permanent Guests:
  • The Head Chief of the Agency Internal Control Body
  • Three members of the non-profit organization that have excelled in the entrepreneurial, educational or economic research areas:
