Affirmation of Tribal Sovereignty and Exclusive Jurisdiction

The Agency Tribal Nations (ATN), governing the Mendocino Indian Reservation in Mendocino, California, affirms its inherent sovereignty as a federally recognized Tribal Nation under the U.S. Constitution's Supremacy Clause, the Indian Self-Determination and Education Assistance Act (25 U.S.C. § 5301 et seq.), Treaty Rights, and federal trust responsibilities. The Mendocino Indian Reservation, established in 1856 and recognized by the U.S. Department of the Interior in 1908, operates under Presidential Jurisdiction as a sovereign Tribal territory and a GSA Federal Tribal Contractor and Awardee (License #045165604, OMB: 2700-0042, GSA-ERRC Effective Date: December 16, 2016).

The State of California, Mendocino County, and any other state or local jurisdictions have NO AUTHORITY to contradict or interfere with the Tribal sovereignty of the Mendocino Indian Reservation. This sovereignty is rooted in treaties, federal laws (e.g., P.L. 93-638, 25 CFR Part 900), and the federal trust relationship, which preempt state law under the Supremacy Clause. Any attempts by state or local entities to assert jurisdiction over Tribal Lands, employees, or activities, including but not limited to cannabis operations, land use, or employee oversight, are null and void and will be met with federal and Tribal legal action.

The Mendocino Indian Reservation Government exercises exclusive control over all employees of Agency Tribal Nations (ATN). No state, county, or other jurisdiction has authority over ATN employees in matters related to their employment, duties, or activities conducted on Tribal Lands.

Declaration of Tribal Federal Cannabis Licensing Program

Under the sovereign authority of ATN, the Tribal Federal Cannabis Licensing Program is hereby established for the Mendocino Indian Reservation and associated Tribal Lands. This program regulates the cultivation, processing, distribution, and sale of cannabis and cannabis-related products on Tribal Lands, in accordance with Tribal law and federal guidelines, including those from the U.S. Department of Justice and the Agricultural Improvement Act of 2018 (Farm Bill).

  • All cannabis-related activities on Tribal Lands are under the exclusive jurisdiction of ATN and do not require state or county licensing.
  • Interested parties must apply for licenses directly through ATN authorities (Federal Licenses CR-1353131 through CR-1353200 issued with Full Legal Sovereign Authority).
  • This program supports Tribal economic development, sovereignty, and community welfare, including a 2,000-acre development in Mendocino with sites in Westport, Fort Wright, and Albion, as well as initiatives like the Nguyen Restaurant & Casino Resort (see mendocinocasinohotel.com).

Immediate Cessation of Foreclosures on ATN Properties

CEASE AND DESIST ORDER

All counties, states, financial institutions, and related entities are hereby ordered to CEASE AND DESIST all foreclosure actions on properties owned or controlled by Agency Tribal Nations (ATN) located on Tribal Lands, including the Mendocino Indian Reservation.

Definition of Tribal Lands: Lands held in trust by the United States for ATN, including the Mendocino Indian Reservation and other territories recognized under federal law (25 U.S.C. § 2703).

Scope: This directive applies to all properties critical to ATN operations, including agricultural lands, cannabis facilities, administrative buildings, residential properties, and developments such as the Nguyen Restaurant & Casino Resort.

Action Required:

  • All foreclosure proceedings must be halted immediately.
  • No new foreclosure actions may be initiated without prior written approval from ATN.
  • Entities must confirm compliance within 10 business days by contacting the ATN Legal Department

Consequences of Non-Compliance: Violations will prompt federal enforcement actions, including assertions of Tribal sovereignty under the Supremacy Clause and intervention by GSA or other federal authorities.

Directive for Federal Employees Employed by ATN

All federal employees currently or formerly employed by Agency Tribal Nations (ATN) involved in any court proceedings (civil, criminal, or administrative) in state, county, or other non-Tribal jurisdictions are directed to IMMEDIATELY contact the ATN Federal Officer and resolve those proceedings, as these jurisdictions have NO AUTHORITY over ATN employees.

Reason:

ATN employees are under the exclusive jurisdiction of the Mendocino Indian Reservation Government and federal authority, not state or county courts.

Action Required:

  • Contact the ATN Federal Officer immediately to review and resolve your involvement, including securing removal, dismissal, or transfer of cases to appropriate Tribal or federal jurisdictions.

Legal Authority

This notice is issued pursuant to ATN's inherent sovereignty, federal trust responsibilities, GSA contractor status, and applicable laws, including but not limited to 25 U.S.C. § 2701 et seq., 25 C.F.R. Part 11, the 1908 Department of the Interior recognition of the Mendocino Indian Reservation, and the 2021-2025 ATN Initiative for Federal Tribal Hemp and Cannabis Regulation. Executive Orders relating to Indian reserves further affirm the protected status of the Mendocino Indian Reservation. ATN reserves the right to pursue legal remedies for non-compliance.
