AGENCY TRIBAL NATIONS today issued Public Notice PN-430, the "Agriculture of Economics," establishing a comprehensive tribal hemp production plan that provides full regulatory authority over hemp cultivation, testing, and compliance under treaty-based sovereignty. This 18-page document creates a complete regulatory framework aligned with USDA requirements while exercising tribal jurisdiction.

COMPREHENSIVE REGULATORY FRAMEWORK

PN-430 establishes detailed procedures in compliance with The TCC for Tribal Hemp Production Plans, including:

§ 990.3 Requirements:

  • ✓ Real-time producer information tracking
  • ✓ Accurate sampling procedures
  • ✓ Validated testing methodologies
  • ✓ DEA-compliant disposal procedures

Laboratory Standards:

  • ✓ Post-decarboxylation testing
  • ✓ Total THC measurement (THC + THCA)
  • ✓ 95% confidence level sampling
  • ✓ Measurement of uncertainty reporting

KEY PROVISIONS OF PN-430 TRIBAL HEMP PLAN:

Sampling & Testing Protocol

  • 1
Samples collected 15 days pre-harvest by tribal enforcement
  • 2
95% confidence level for sampling accuracy
  • 3
Total THC testing (including THCA conversion)

Compliance & Enforcement

The PN-430 document establishes Agency Tribal Nations as having primary regulatory authority over hemp production within its territory, in accordance with the 2018 Farm Bill and subsequent USDA regulations. The plan includes detailed procedures for licensing, sampling, testing, and enforcement that meet or exceed federal requirements.

"This isn't just about hemp regulation—it's about exercising our inherent treaty rights to govern our lands and resources," stated Chief Geronimo Thomas Langenderfer XVIII. "PN-430 demonstrates that tribal sovereignty provides the most comprehensive and effective regulatory framework for agricultural development, particularly as federal hemp regulations face increasing uncertainty."

SCIENTIFIC TESTING METHODOLOGY

PN-430 specifies laboratory procedures that ensure accurate THC measurement:

Sample Preparation:

Samples dried to 5-12% moisture content, milled through 1.5mm screen, separated into Test Specimen and Retain Specimen

Testing Standards:

Post-decarboxylation methods (gas/liquid chromatography) measuring total available THC from THC + THCA content

Quality Assurance:

Laboratory validation, measurement uncertainty reporting, and DEA reverse distributor compliance for disposal

COMPREHENSIVE ECONOMIC DEVELOPMENT

Beyond regulatory compliance, PN-430 outlines a visionary economic development plan for the Mendocino Indian Reservation:

3,000

Hemp Farms

Target of 3,000 hemp farms across Mendocino County on tribal lands

Industrial Park

Mixed-use development with docks, wharfs, hempcrete construction

Tribal University

Research center for hemp applications and sustainable technologies

FEDERAL AGENCY COORDINATION

PN-430 establishes information sharing protocols with multiple federal agencies:

OMB
USDA
EPA
DOI
SBA
HUD
DOE
DOL

The plan includes FSA crop reporting, USDA identifier assignment, and 30-day information submission requirements.

"PN-430 represents the most comprehensive tribal hemp regulatory framework in the nation. We're not just creating rules—we're building an entire economic ecosystem that respects our sovereignty while meeting the highest scientific and regulatory standards. This is what true self-determination looks like."
